Michael O’Keefe Jr., owner of Citywide Mortgage Co., was this week indicted for “house-flipping.” Several others also have been charged stemming from investigation of Citywide Mortgage. IT IS ASTONISHING that the Citywide clan is being prosecuted for acts which are minuscule compared to the longtime illegal “flipping” and fraudulent real estate schemes engaged in by debt collector attorneys, by Wells Fargo and by Freddie Mac!

Despite the axiomatic definition of “flipping,” narrowly limiting to be simply flipping acts like O’Keefe’s ignores the continual destructive and glaringly dubious Louisiana foreclosures which become accomplished not in accordance to law.

Prior to even the possibility of a “flipped” property, a debt collector and a borrower who defaults on her or his mortgage loan is essential.  It’s common knowledge that “flipping” means quickly buying and reselling property for a profit. Indeed, the creditor to whom the debt is owed is entitled to exercise its rights by lawful use of established laws. Albeit, defaulting on a debt is not unlawful. What is unlawful are acts of collecting that debt by fraudulent means –except in Louisiana where illegal debt collection is tolerated (and hallowed).
Again, after a borrower defaults, a real estate foreclosure begins through an attorney/debt collector. (Some borrowers avert foreclosure auctions by various methods including filing bankruptcy or selling the properties on their own.) However, the harshness of foreclosure requires compliance with established laws. Failure to foreclose in accordance to law complicates and sometimes prevents the creditor’s objective, as DUE PROCESS is a fundamental, and Constitutional right even for defaulting borrowers. Thus, when fraud, deceit, or manipulation of any form become utilized for buying and reselling property, such buying / selling is illegal (fraudulent) flipping of real estate.

In my state of Louisiana, unlawful exploitation of defaulted property owners while unjust and illegal enrichment occurs is the norm. Unfortunately and ironically, New Orleans is embroiled in the White Collar investigations of the TWO Whistleblower lawsuits involving the LIFT film industry and Flood Insurance kickback allegations; as well as the indictments of Congressman William Jefferson and Michael O’Keefe, Jr. Incredibly, the White Collar crime which surpasses all that is the ongoing fraudulent foreclosures of property, illegal flipping, and serious fraudulent representations to the courts in order to accomplish real estate and mortgage frauds.

It cannot be ignored that but for defaulting on one’s loan debt collection is unlikely. But it also cannot be ignored that mortgage creditors are doing things such as subprime lending, violating Truth in Lending laws which create foreclosure situations. Furthermore, mortgage creditors like Wells Fargo and Freddie Mac have practices of hiring unscrupulous debt collectors like attorney Herschel C. Adcock, Jr., and the Dean Morris law firm. In too many instances, Adcock and Morris violate the law and engage in various racketeer conduct for accomplishment of getting deeds recorded out of the names of the defaulted borrower, which allows mortgage companies to flip property which has been fraudulently acquired due to racketeer acts of Adcock and Morris. Repeated acts of fraud and false representations in the process of repossessing property should not be necessary for creditors to obtain its security interests in real estate property. But fraud and deceit is the intent behind subprime lending! And, for years, it has been the activity of racketeers like Adcock and Dean to pillage Louisiana by use of many fraudulent and / or unlawful foreclosure proceedings. By the same token, occasionally some negligent mortgage creditors hire Adcock or Dean fail to concern themselves with the unlawful methods being utilized in repossessions and foreclosures and moveable and immoveable properties. Furthermore, in some instances, fraudulent representations of the debt collector has led some property owners to onerous unnecessary decisions which forfeited any rights they might have had. For reasons such as these, the Federal Reserve System enacted THE FAIR DEBT COLLECTION PRACTICES ACT (FDCPA), as amended by Public Law 104-208, 110 Stat. 3009 (Sept. 30, 1996), codified under 15 U.S.C. § 1692, et seq.  Notwithstanding, in Louisiana the FDCPA is an apparent affront to maintaining infamous Louisiana corruption.  Accordingly, also unfortunate is the fact that a person whose debt collection rights have been violated has no recourse other than to seek relief through the UNjust Louisiana judicial system.
Even though not all Louisiana judges are corrupt, overwhelming facts and the proof demonstrate that certain not-yet-convicted federal and state judges in Louisiana are either corrupt or inept or a combination of both! Therefore, not until SUCCESSFUL EXPOSURE of these judges, along with public presentations of how all of society is harmed by these judges’ failure to apply established laws, violence and crime and cronyism and racism and elitism and ineptness and corruption will continue to be Louisiana’s undoing. Furthermore, it seems absurd to indict Michael O’Keefe, Congressman Jefferson, or others while at the same time parading for all citizens’ view, the blatant racketeering involving real estate and mortgage fraud which has been going on in Louisiana for many years.

Below are some examples of foreclosed properties that became flipped. The legality or illegality of the flipping can be ascertained from various sources such as records, court pleadings, and the defaulted borrower. The Katrina diaspora caused some of these borrowers to be forever gone from Louisiana. But if there was any interest in JUSTICE court records, facts, and documents yet remain which could reveal Louisiana real estate fraud racketeering.

ON A DIFFERENT NOTE, as already mentioned (unless people duke it out in the streets), people look to the court system for remedies and enforcement of their rights when those rights are meaningful enough.  However, the corruption for which Louisiana is world-renown includes Louisiana judges. Some corrupt judges have been convicted, and some may never be convicted because corruption within the arena of judges is a hallowed thing.  

Further aggravating is the fact of repeated revelations about the United States Attorneys Office of the Eastern District of New Orleans taking pains to selectively cover for certain judges such as those at the Municipal Traffic Court ( as well as the federal judge whose impeachment is now being sought)!  THE BAD EXAMPLES OF CERTAIN JUDGES AND CERTAIN PERSONS IN POSITIONS OF PUBLIC TRUST plays major roles in New Orleans crime! How can the crooks who become arrested conceptualize what is NOT a criminal act when so many non-arrested crooks have prominent positions of authority in city government?

A judge who will probably never face investigation, despite that he conducts his court in ways which promote social violence, poverty, and racketeering is Judge Herbert A. Cade. Mr. Doley’s longtime perks and contributions to New Orleans judges has especially paid off for Doley in Cade’s courtroom.  In fact, the Cade / Doley scenario regarding my divorce case mirrors the Bodenheimer / Copeland divorce case along with the “Operation Wrinkled Robe” scandal. Disregard for the appearance or possibility of impropriety would make a judge like Cade unconcerned about his affiliation with the 135 corporations listed below. Also, I personally know of no accusation to make about Judge Kern Reese, but Reese’s affiliations rank next after Cade’s corporation affiliates. All other Civil District Court judges in New Orleans either have no such affiliations or very few. But no judge other than Cade is affiliated with corporations involved in real estate property. Emphatically, Cade’s ties to all these businesses causes reasonable concern about his ability to be impartial.

It is becoming an audacious pattern that average people with legal controversies are forced to go to televised courtrooms, while judges like New Orleans Herbert Cade receives undeserved and pointless pay increases, along with perks such as cruises, travel, and anything else from the public trough. And further, the New Orleans Clerk of Court, Dale N. Atkins, admittedly steers cases to the judge of her choice, and critical court documents manage to become missing court records. Is there any wonder how prosecuted criminals can be confused by the criminals who go unprosecuted?
